1. Scope of Agreement


Overview: These Terms of Service (“Terms”) govern your use of the adu-checklist.com website (the “Site”) and your purchase or use of any digital products offered by Domera via the Site. Domera (“we,” “us,” or “our”) is a marketing company registered in Estonia and provides informational PDF guides related to Accessory Dwelling Units (“Products”), such as The Ultimate ADU Checklist, ADU Landlord’s Playbook, and Contractor Blacklist. By accessing our Site or purchasing our Products, you (“you” or “the Customer”) agree to be bound by these Terms. If you do not agree, please refrain from using the Site or purchasing our Products.

No Account Required: Customers are not required to create a user account on the Site. During checkout, we only collect your name and email address, which are used to fulfill your order (e.g. to send download links and future updates) and to provide customer support. We do not store any credit card or payment details on our servers – all payments are handled securely by Stripe or Paypal. By providing your payment information at checkout, you authorize us to charge the applicable purchase price. (See Section 3 on Purchases & Payment for more details.)

Informational Service Only: Domera’s Site and Products are intended for informational and educational purposes to help you in your ADU projects. They do not constitute professional advice (legal, financial, or otherwise), which is further disclaimed in Section 5 below.

Acceptance of Terms: This agreement forms a binding contract between you and Domera once you use the Site or make a purchase. It outlines each party’s rights and obligations. Please read these Terms carefully. We reserve the right to update or modify these Terms from time to time, and such changes will be effective when posted on this page. It is your responsibility to review the Terms periodically for updates. Your continued use of the Site or Products after changes are posted constitutes acceptance of the revised Terms.


2. Digital Product License (Single-User License)


When you purchase a Domera digital guide, you are buying a license to access and use that Product for your personal use or your own business use only. This license is single-user and non-transferable (meaning it is limited to you (the original purchaser) and cannot be shared, sold, or given to others.) You may download, save, or print the PDF for your own use, but you may not distribute it to anyone else or publish it publicly. In other words, all Products remain the intellectual property of Domera, and purchasing grants you a limited use license rather than ownership of the content.

Permitted Uses: You are allowed to use the purchased PDF guide for your personal reference and project planning. You can take notes on it, print a copy for easy reference, and implement the tips or checklists for your own ADU project. If you are a landlord or homeowner, you may also use it for managing your own properties or projects.

Prohibited Uses: You may not do any of the following with our Products:

  • No Resale or Sharing: You cannot resell, redistribute, or share the PDF or its content with others (either for free or for profit). This means you should not email the file to others, upload it to file-sharing websites, or otherwise make it available to anyone who has not purchased it.

  • No Reproductions or Derivatives: You cannot copy, modify, or create derivative works from the Product’s content for any public or commercial purpose. For example, you may not extract portions of the text or graphics to include in your own publications, courses, or products without our permission. You also may not claim our content as your own or remove any Domera branding or copyright notices.

  • Single Use Only: Each purchase grants a license for one individual user. Businesses or organizations that wish to share content internally must obtain a license for each intended user. (Please contact us if you need group licensing.)

  • Site Use Restrictions: You agree not to use the Site in any unlawful or abusive manner. You will not attempt to interfere with the proper functioning of our website (e.g. through hacking, scraping, or introducing malware). You also agree not to use any content from our Site (text, images, or code) for any commercial purpose without our express written consent.

Digital Delivery & Updates: All our products are delivered in digital format only (typically PDF). No physical goods will be shipped. Upon completing a purchase, you will instantly receive access to download the PDF file (a download link will be provided on the checkout confirmation page and via email). Your purchase also entitles you to lifetime updates of that product at no extra cost. If we update or expand the content in the future (for example, adding new chapters or resources to The Ultimate ADU Checklist), we will send the updated version to the email address you provided at purchase. Make sure to provide a valid email so you can receive these updates and important product information.


3. Purchases & Payment


Pricing: All prices for our Products are displayed on the Site in the applicable currency. Payment for any Product is a one-time purchase (there are currently no subscription or recurring fees). Should we introduce subscriptions or additional services (such as expert consultation sessions) in the future, those will be clearly explained and subject to updated terms.

Payment Processing: We use trusted third-party payment processors (such as Stripe and PayPal) to handle transactions. This means your credit card or payment details are never seen, handled, or stored by Domera – all sensitive payment data is processed securely by the payment processor. By making a purchase, you agree to the payment processor’s terms and conditions in addition to our Terms. We currently accept major credit/debit cards (and possibly other methods as indicated at checkout) through these processors. Once your payment is successfully completed, you will receive an email receipt and the download link for your Product.

Secure Checkout: Our checkout process is SSL-encrypted and uses industry-standard security measures to protect your information. If you encounter any issues during payment or download, please contact us at our support email (provided in Section 9).

Taxes: If any sales, value-added, or similar taxes apply to your purchase based on your location, they will be indicated at checkout. As a customer, you are responsible for any applicable taxes or charges required by your jurisdiction, unless we have explicitly included them in the price.


4. Refund Policy – 30-Day Money-Back Guarantee


We want you to be 100% satisfied with our Products. If you purchase one of Domera’s PDF guides and find no value in it, you are protected by our Ironclad 30-Day Money-Back Guarantee. Here’s how it works:

  • Eligible Period: If, within 30 days of your purchase date, you decide that the Product isn’t valuable to you or does not meet your expectations, you can request a full refund of the purchase price. This refund policy applies to all our digital Products.

  • No Questions Asked: We stand by our guarantee, so you do not have to explain or justify your reason for the refund. Simply contact us within the 30-day window, and we will honor the refund no questions asked.

  • How to Request a Refund: To initiate a refund, send an email to our support address ([email protected]) with your order information (order number or the email used at purchase) and a brief request for a refund. We will process qualifying refund requests as quickly as possible, typically within a few business days. Your money will be returned via the same method you used for payment (e.g. back to your credit card).

  • Access After Refund: Once a refund is processed, your license to use the Product is revoked. We ask that you delete any copies of the digital Product that you obtained, and you will not receive further updates for that Product. (We rely on the honor system given the nature of digital goods and our generous refund policy.)

  • Abuse of Refund Policy: Our 30-day refund guarantee is designed to ensure customer satisfaction, not as a free rental system. We reserve the right to refuse refunds to any customer who we believe is abusing the policy (for example, repeatedly purchasing products and requesting refunds in a manner that appears fraudulent or exploitative). However, we will always communicate with you if we have concerns and strive to be fair.

  • After 30 Days: If more than 30 days have passed since your purchase, refund requests will typically not be honored. In special circumstances (e.g. a major issue with the product or accidental duplicate purchase), please contact us and we will work with you to find an acceptable solution, but after 30 days refunds are at our discretion.


5. Disclaimer – No Professional Advice


All information, content, and materials provided by Domera (whether on our Site, in our email communications, or in the PDF Products themselves) are offered for general informational and educational purposes only. They do not constitute legal, financial, real estate, or architectural advice. Domera is not a law firm, financial advisor, or engineering firm, and our Products are not a substitute for professional advice tailored to your specific situation.

For example, while our ADU guides provide comprehensive insights into planning and budgeting for an ADU, you should still verify local building codes, zoning laws, and other regulations with the appropriate authorities or professionals. We strongly recommend consulting licensed professionals (such as attorneys, accountants, architects, contractors, or financial planners) before making any decisions that could have legal or financial implications for your project. Any actions you take based on the information from our Site or Products are taken at your own risk.

No Guarantee of Results: We strive to ensure that our content is accurate and helpful, but we do not guarantee that following our checklists or advice will lead to any particular outcome (e.g. approval of permits, specific cost savings, or investment returns). Every ADU project is unique, and results can vary widely based on factors outside our control (such as local laws, construction costs, or individual execution).

Not Legal or Financial Advice: Using our Products does not create any professional-client relationship between you and Domera. For instance, buying The Ultimate ADU Checklist does not make Domera your legal or financial advisor. Always seek the advice of qualified professionals for questions pertaining to law, finance, safety, or other areas where expert guidance is needed. The materials we provide are prepared in good faith for general information, but they are not guaranteed to be free of errors or omissions, and they are not updated in real-time as laws change. We disclaim any liability for how you use or interpret the information (see Section 6 on Limitation of Liability).

In summary, Domera’s content is provided “as is” for informational purposes, with no warranties or guarantees. You are solely responsible for how you implement the information.


6. Limitation of Liability


By using our Site or Products, you agree that Domera (and its owners, employees, contractors, and affiliates) will not be liable for any damages or losses arising out of or in connection with your use of the Site or Products, to the fullest extent permitted by applicable law. This limitation of liability covers a broad range of potential claims and damages, including but not limited to:

  • Indirect or Consequential Damages: Domera is not responsible for indirect losses such as lost profits, lost revenue, loss of business opportunities, loss of data, or similar economic losses that may result from using (or inability to use) our Products or Site. For example, if your ADU project faces delays or increased costs despite using our checklist, we are not liable for those project losses.

  • Direct Damages Cap: To the extent any liability is not legally disclaimable, our liability shall not exceed the amount you paid for the product or service in question. In other words, the maximum compensation we would potentially owe you (in the unlikely event we are found liable for something) is limited to the purchase price you paid to us.

  • No Liability for Specific Risks: Domera will not be liable for any claim arising from issues beyond our control, such as third-party problems (for instance, issues caused by Stripe/PayPal, email service outages, web hosting downtime, etc.), or events like data breaches, viruses, or other technological harm, provided that we have taken standard precautions. We also are not liable for any personal injury, property damage, or other tangible losses that might occur in the course of your ADU project – remember, we only provide informational guides and do not oversee your project.

  • Provided “As-Is”: Our Site and Products are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. While we work hard to make our content accurate and useful, we do not warrant that it is error-free or fit for every purpose. You assume full responsibility for your use of the information.

Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities, so the above limitations may not apply to you in their entirety. However, in such cases, our liability will be limited to the maximum extent permitted by law.


7. Governing Law and Jurisdiction


This agreement and any disputes or claims arising out of it shall be governed by the laws of the Republic of Estonia, without regard to conflict of law principles. Both you and Domera agree that any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of Estonian courts. By using our Site or purchasing our Products, you consent to Estonia’s jurisdiction for resolving any legal matters.

If you are a consumer located outside Estonia, you may also be entitled to certain protections or remedies under the laws of your country of residence. These Terms are not intended to override any such mandatory rights. However, to the extent permissible, any disputes shall still be brought in Estonia as noted.

We also encourage resolving any disagreements in good faith through negotiation or mediation before resorting to legal action. Your satisfaction is important to us, and we will do our best to address any concerns that arise. (Nothing in this section limits our ability to seek injunctive relief in appropriate cases in any jurisdiction, if necessary to protect our intellectual property or enforce these Terms.)


8. Intellectual Property & Prohibited Uses


Ownership: All content on our Site and in our Products – including text, graphics, logos, design elements, video/audio clips, and the PDFs themselves – is the intellectual property of Domera (or of our content suppliers) and is protected by copyright, trademark, and other intellectual property laws. Domera retains all rights, title, and interest in and to its content. Purchasing a Product or using our Site does not transfer any ownership rights to you; it only grants the limited license described in Section 2. Our brand names, logos, and product titles (“Domera,” “The Ultimate ADU Checklist,” etc.) are trademarks or service marks of our company. You may not use Domera’s name or logos in any way that misrepresents our company or is not authorized by us.

Prohibited Uses of Site and Content: In addition to the license restrictions in Section 2, you agree not to misuse our Site or content in any way. This includes, without limitation:

  • No Unauthorized Copying or Distribution: You will not copy, reproduce, or distribute any part of the Site or Product content except as expressly permitted by these Terms. Any unauthorized sharing of our materials (whether by email, cloud storage, or other means) is a breach of these Terms and may also violate copyright law.

  • No Commercial Exploitation: You will not use our content for commercial purposes other than for your personal benefit. For example, you cannot incorporate our checklist into a workshop you sell, or use our text in marketing materials for your business, without getting written permission from Domera. The Products are for your personal use and are not to be used to train or create content for others (unless such use is explicitly allowed under a separate license).

  • No Reverse Engineering or Derivative Use: You shall not attempt to extract the source files, underlying code, or design elements from our digital Products, nor create any software or tool that incorporates our content.

  • Website Conduct: You agree not to engage in any activity that interferes with or disrupts the Site (e.g. deploying malicious code, attempting to bypass security measures, or spamming our contact forms). You also agree not to use the Site to harass, defraud, or harm any other person, and not to collect data from other users (if any) without consent. Essentially, our Site is to be used for its intended purpose – to learn about and purchase ADU-related guides – and nothing else.

Violating the intellectual property rights or the above use restrictions may result in termination of your access to the Site or Products, and could incur legal consequences. We appreciate your integrity in using our content responsibly. If you are unsure whether a particular use of our content is allowed, please contact us for clarification.


9. Changes to Services and Terms


Modification of Products: Domera reserves the right to modify, discontinue, or add to our Products or services at any time. This could include updating an existing PDF guide, changing the price, or offering new services (such as expert consultation sessions or subscription plans). We will endeavor to inform users (via the Site or email) of significant changes to our offerings, especially if they impact existing customers. For example, if we launch a new edition of a guide, we will notify purchasers so they can download the update.

Updates to Terms: As mentioned in Section 1, we may update or revise these Terms of Service from time to time, especially if we introduce new services or as laws evolve. When we do, we will post the revised Terms on this page with a new “Last Updated” date. Material changes may also be announced via email to customers or via a notice on the Site. It is your responsibility to review these Terms periodically. By continuing to use the Site or our Products after any changes become effective, you agree to the updated Terms. If you do not agree with a change, you should discontinue use of the Site and Products. These Terms (and any future modifications) constitute the entire agreement between you and Domera regarding your use of the Site and purchase of Products, and supersede any prior agreements or understandings.


10. Privacy & Data Use


Your privacy is important to us. Domera’s collection and use of personal information is governed by our Privacy Policy (see the Site’s Privacy Policy page for full details). In summary, and as noted in Section 1, we only collect the minimum necessary personal information at purchase – typically your name and email – to process your order and deliver the Product. We may also use your email to send you product updates, receipts, or customer support responses. We will never sell or rent your personal details to third parties for marketing.

We utilize certain trusted third-party services to operate our business: for example, we use the GoHighLevel CRM platform to manage email communications and customer relationships, and we use the Meta (Facebook) Pixel on our Site to understand user interactions and improve our marketing (this means some data about your visit may be shared with Facebook/Meta, according to their data policies). These tools help us deliver a better experience, but they are governed by their own privacy terms. By using our Site, you consent to our use of these tools as described. Any tracking or cookies used are disclosed in our Cookie/Privacy notice on the Site.
